On the 50th anniversary of the assassination of Martin Luther King, Jr., I wanted to honor and reflect his passion for achieving economic justice and empowerment as a predicate for achieving social justice. MLK is generally remembered as a civil rights leader, but his vision of civil rights was completely intertwined with his drive to expand economic opportunity. That freedom of the spirit was incompatible with lack of economic opportunity. Less than a week before he was killed in Memphis, he gave a speech at the National Cathedral entitled “Remaining Awake Through a Great Revolution” in which he contrasted lack of economic opportunity with the founding principles of our Nation. He said:

Copyright as a tool for economic emancipation is not something that one hears everyday, and it assuredly needs more exposure. To advance the interests of societies around the globe, it is essential that we generate a greater understanding of the role of intellectual property as a tool for economic emancipation, a catalyst for cultural diversity, and a powerful protector of individual dignity and fundamental human rights.

I noted this relationship in comments I submitted to the United Nations Special Rapporteur in 2014:

“An effective and functional copyright environment is not a panacea; it does not on its own create global parity in the marketplace of ideas. But it does give individual creators a fighting chance, and an opportunity to compete. The ability to generate revenue from one’s creativity — to earn a living as a creator — is central to a society’s ability to foster cultural production. In its absence, dreams and creative lives perish. The moral and economic aspects of this equation are inseparable. We simply must ensure that all creators, regardless of their location, are able to enjoy the fundamental human right to choose the manner in which their creations are used as reflected in international law.

It is essential that policy makers remember that systems of copyright replaced private patronage as the mechanism for permitting creators to live through their craft. It does not serve the aspirations of developing societies to return to a system in which the voices of the people serve the whims of the private elite, or worse, to allow governments to be the sole determining body in the matter of cultural works. By permitting creative genius to be fueled by market forces, we unleash the cultural power and potential of the diversity of individuals, freeing creative impulses from the tyranny of centralized controls and making creative works accessible to the public at large. While copyright may be inadequate on its own in creating fair market conditions, it remains by far the most powerful tool for fostering creativity and democratizing culture itself.

It is also critical that we create a greater awareness that copyright is, after all, about the protection of the individual and the creator’s personality. Copyright protection, while it may sometimes serve the interests of multinational corporations, is the mechanism that permits individuals to devote their lives to the creation of original materials; it serves as a catalyst for the preservation and growth of cultural identity. Societal understanding of this more complete and complicated picture of the objectives and functioning of the copyright system is critical for ensuring that policy decisions derive from reason rather than rhetoric, and that the public enjoys a greater appreciation for a dynamic that is not immediately discernible from the outside.

While a superstar in Los Angeles and a struggling musician in Harare may lead very different lives, their creative existences stem from the same source — the robustness of the copyright protection that permits them to make a living from their craft. If we want to foster cultural diversity (and I assume we all do), and want to ensure that diverse content is available to be accessed (and I assume we all do), then we must be more vigilant in ensuring the effective global protection of copyright.”

It is important in today’s debates to bear in mind that we will not effectively promote “creativity” as an abstraction if we fail to protect creators. And protecting creators provides a form of economic emancipation that is literally indistinguishable from the pursuit of happiness.

It has been lovely to have a nice lie in and wake up to so many Birthday wishes on social media.

One of the best things about social media is how so many people are able to stay in contact with each other and spread a little love to each other on special occasions.

Today I will do the same things as I do everyday, which is wake up meditate, do yoga, write my latest book called ‘ How To Be Fit@Fifty — In Seven Simple Steps’ go for an extra long walk with Zeus, practice some handstands and capoeira and do a few conferences with my partners around the globe

Some people might think why are you doing that on your Birthday, why are you not relaxing, not doing anything except eating cake and drinking with friends?

But I am doing what I love doing, I love doing yoga, I love writing and I love going on long walks, playing about with capoeira and handstands it’s not work, it’s a way of life, that’s why I am Fit@Fifty, well actually I am Fifty-one now, but Fit@Fifty-One doesn’t really work as a title so Fit@Fifty it is.

Have a tremendous Tuesday peeps, I am off to get on my yoga mat, walk the dog, then eat lots of food and cake, have a few drinks and finish the night with a call to Bali, after all it is my Birthday and Life is all about balance.

African-Americans have been oppressed since before and after 1619. Dr. King, was the person who taught me. If you want to help your people you have to help all the people. Over the years we have added groups to these laws that specifically, designed for protection.

One reason for this is because African-Americans are known for their strengths and have a rich, long history of never being a victim due to our solidarity of black power.

Attributes, which have been associated with black people according to observation.

Though, I believe it’s safe to say, no one felt it a compliment once captured and enslaved.
I’m sure there were many reasons put forth and considered why white folks, thought Africans, would make good slaves.

However, I don’t want to get off topic,…African-Americans, need new laws, legislation to ensure their survival in this country. Due to the United States, becoming and has become so, diverse.

It needs to be protections put in place, with not just African-Americans in mind. But with wording. More transparency. More focused care.

Words on paper, not just hoping people will do the right thing, but we have to be realistic, when it comes to African-Americans, we see over and over again. People are not doing the right thing.

At the highest rate of willfully, purposefully harmful acts are against African-Americans. African-Americans need specialized protections under the rule of law.

We cannot continuously hack at the base of the tree and expect it not to fall. And then say to the tree. I thought you were stronger than that.

The poorest neighborhoods that house African-Americans with high poverty are the ones with highest death rates, medical issues and much, much more. Even with supported data, poverty not just hitting this group.

We are still the most affected in record numbers. The system as it is, does not help us. Not really,… And it can.

For my people, the disparities, inequalities and the injustices, the list goes on and on.

Racism against African-Americans is embedded in the hearts and minds of every single American citizen in this United States. Even with all the provisions to help people.

It’s still African- Americans who are being oppressed. The United States can can fix what is broken. Give reparations to all the descendants of africans in this country.

The Time is Always Right to Do What is Right — How Will Financial Advisors Respond?

As the great Dr. Martin Luther King once said, “The time is always right to do what is right.”

Our new President and his administration have ordered the Department of Labor to conduct further economic and legal analysis on the fiduciary rule, questioning the rule’s mandate that financial investment advisors must “do what is in the best interest of their clients”. To outsiders of the financial services industry, it may be frightening that this seemingly obvious obligation even needs to be a written law. As an insider, I will tell you that, while not all investment firms are “bad” and there are even many upstanding advisory firms, there are also many companies, primarily in the broker-dealer channel, that have made a living pushing products for commissions and charging confusing fees to line their own pockets.

We at Vestwell believe much of the financial services industry has already adopted what the rule spiritually embodied. The public has woken up, thankfully, and they now demand this kind of transparency! The Trump administration’s litany of executive orders, comments on the need for deregulation of the industry, and plans to repeal the Dodd-Frank Act and delay the fiduciary rule have had the unintended effect of raising the average investor’s awareness of the kinds of conflicts of interest that might be influencing their financial advisor.

As a financial advisor, if you think you are going to revert back to the way things were because the Trump administration says you can, your days in the business are probably numbered. The days of justifying “value through complexity and confusion” are in the past. The idea of advisors needing to “do what is right” is also finally focusing on the retirement needs of our citizens. The public’s awareness of the issues in the financial services industry has really helped us at Vestwell to communicate our mission and core competence: to increase transparency of retirement platforms and decrease costs by nearly 50% with the goal of helping the average investor save more for retirement.

Arguably, heightened awareness started with Dodd-Frank Act, after the 2008 crisis. Dodd-Frank has had many frustrating implications, one being that lending has become more difficult due to heightened standards and regulatory oversight which increased the amount of administrative work involved in fulfilling a loan request.

Whether the rule is delayed, watered down, or eliminated, many industry-leading firms have already walked down the path of becoming even more transparent in their fee and disclosure statements. Many firms, anticipating the regulatory changes, have spent millions of dollars to revamp their business models, steering advisors away from commission-based investments and expensive products, while also evaluating new offerings. The courts have ruled in favor of the new fiduciary rule a few times in the last couple weeks. Leading broker-dealers, such as LPL Financial, have publically stated that they are going to follow the new standard even if the rule is repealed or delayed. We anticipate the commitment to act in the best interest of clients to becoming a marketing tool, in any instance.

The trend is your friend: SEC fiduciary standards have been becoming best practice for advisors for years, as can be seen by the staggering 44% growth in Registered Investment Advisor (“RIA”) registrations in 2015[1]. Compare that to the number of advisors shrinking at wirehouses and independent broker-dealers at a clip of 16.5%[2] from 2010 to 2015. These advisors most likely saw the writing on the wall and are now benefitting from the constant belaboring of the fiduciary rule. According to Cerulli Associates, a global analytics firm, RIA channel assets grew faster than any other advisor channel, at 6.2% for RIA channels versus 0.9% for all channels. Granted, we cannot necessarily attribute these growth rates solely to the anticipation of new fiduciary standards, but I believe that the fiduciary rule had a lot do with it.

Now, for those of us who are living and breathing the financial industry, we know how difficult it can be to manage the challenges of some of these regulations even if we agree with them in spirit. Sometimes the level of specificity of the requirements make me feel like I need to have an audit log to track things as insignificant as the two minutes it takes me to I step out of my office to get a coffee. I’m not against rethinking the nuances of these regulations and how they are applied to the industry, but I am also not an advocate for complete deregulation and reverting back to the Wild West days of old.

The truth is, we are in the services business. If we don’t care about our clients and about looking out for their future in the best way possible, I believe we shouldn’t be in this business. At Vestwell, whether the fiduciary rule is revised or rescinded, we’re staying true to our commitment to providing advisors with tools, technologies, and services to help them do the right thing for their clients. It’s simply the right thing to do.
